1. Agreement to Terms
By creating an account on Codemancy or engaging our software development services, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you may not use our services.
2. Scope of Services
Codemancy provides custom software development services including but not limited to: website design, mobile application development, e-commerce platforms, admin panels, web applications, and systems architecture consulting. The specific scope, timeline, and deliverables for each project will be discussed and agreed upon via WhatsApp consultation before order creation.
3. Pricing & Payment
- All project pricing is determined through direct consultation and agreed upon before order placement.
- Payment must be submitted through the approved payment methods listed on the platform (EasyPaisa, JazzCash, Bank Transfer).
- A payment screenshot must be uploaded through the client dashboard for verification.
- Development work begins only after payment has been verified and approved by the Codemancy accounts team.
4. Refund Policy
- Before Development Starts: A full refund may be issued if the project has not entered the development phase.
- During Development: Partial refunds may be considered based on the percentage of work completed, at the sole discretion of Codemancy.
- After Delivery: No refunds will be issued once the final deliverables have been handed over and accepted by the client.
- Disputes: Any disputes regarding refunds must be raised within 7 days of delivery. Codemancy reserves the right to make the final decision on all refund requests.
5. Revision Policy
- Free Revisions: If the Codemancy team has missed or incorrectly implemented any detail that was explicitly provided by the client in the original project brief or WhatsApp discussion, the revision will be made at no additional cost.
- Paid Revisions: Any changes, additions, or modifications that were not part of the original agreed scope — including new features, design changes, or scope expansions — will be subject to additional charges. The cost will be discussed and agreed upon before work begins.
- Revision Window: Revision requests must be submitted within 14 days of project delivery. After this period, all changes will be treated as new work orders.
6. Intellectual Property
- Upon full payment, the client receives ownership of the custom code and design assets created specifically for their project.
- Codemancy retains the right to use general-purpose libraries, frameworks, and boilerplate code across projects.
- Codemancy reserves the right to showcase completed projects in its portfolio unless the client explicitly requests otherwise in writing.
7. Confidentiality
Codemancy commits to maintaining the confidentiality of all client data, business logic, proprietary information, and credentials shared during the project. Client information will not be disclosed to third parties without prior written consent, except as required by law.
8. Client Responsibilities
- Provide accurate and complete project requirements during the consultation phase.
- Respond to feedback requests and approval checkpoints in a timely manner to avoid project delays.
- Ensure that all content, images, and materials provided for the project do not infringe upon any third-party copyrights or intellectual property rights.
- Maintain the security of their account credentials and notify Codemancy immediately of any unauthorized access.
9. Limitation of Liability
Codemancy shall not be held liable for any indirect, incidental, or consequential damages arising from the use or inability to use the delivered software. Our total liability shall not exceed the amount paid by the client for the specific project in question. Codemancy is not responsible for losses caused by third-party services, hosting providers, or external API failures.
10. Project Timeline & Delays
Codemancy will make every reasonable effort to deliver projects within the agreed timeline. However, delays caused by incomplete client requirements, late feedback, scope changes, or force majeure events shall not be the responsibility of Codemancy. In such cases, the deadline will be extended accordingly.
11. Termination
Either party may terminate the engagement with written notice. In the event of termination, the client shall pay for all work completed up to the date of termination. Codemancy reserves the right to terminate services if the client engages in abusive, fraudulent, or unethical behavior.
12. Governing Law
These terms shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. Any disputes arising from these terms shall be resolved through mutual consultation, and if necessary, through the appropriate legal channels in Pakistan.
